ETIQUETTE POLICY


At KALAA we believe in freedom of expression; however this will not be allowed to infringe on basic rights of other members, buyers or artists. All members and even casual users of this website – www.kalaa.in are expected to be familiar with the rules of etiquette we espouse. Any infringement we discover or that is reported to us will be taken seriously and suitable action initiated.


Artists need to be registered with KALAA before their works are accepted by KALAA for listing. Once registered, all manner of art is welcome to be submitted for listing provided they meet our etiquette and copyright policies.


Buyers need to be registered with KALAA before they can buy or bid for art on www.kalaa.in. Once registered they can buy any artwork provide they agree to comply with our etiquette policy and our General Terms and Conditions of Sale.


All members, including Artists and Buyers, are required to agree with the following, if they want to use and enjoy the features and services offered at www.kalaa.in.


GENERAL ETIQUETTE POLICIES

  1. The site www.kalaa.in is for Members personal use and the web domain the logo, site design are the sole and exclusive property of the registered company, M/s KALAA Artspace Pvt. Ltd. The features and functionalities of the site are made available to members on a non-exclusive, non-transferable, limited basis, without creating any ownership rights thru its use, provided Members comply with the Etiquette Policy and the TERMS & CONDITIONS OF USE

  2. Members cannot copy or use any material from this site, www.kalaa.in, without permission from the Company, KALAA Artspace Pvt. Ltd. This includes but is not limited to any text, images, audio or video, no matter what the purpose; be it for profit or not-for-profit

  3. Members/users that resort to any form of Site Abuse such as disrupting or defacing the website features and functionalities will be immediately banned from the site and their membership terminated without any notice. Legal options, if available may also be considered.

  4. We provide all members an opportunity to post comments on the site. Members must not abuse this privilege by posing comments that are abusive, bigoted, racist, sexual, or deviant in nature, or in any way offensive to any particular person, company, organization, faith or country. Any such comments that are deemed insulting or abusive will be promptly removed from the site and suitable action initiated against member.

  5. We expect members not to ‘spam’ (sending large number of identical messages) or ‘flood’ the site and chat forums which might lead to disruption.


ADDITIONAL ETIQUETTE POLICIES FOR ARTISTS

  1. The artworks submitted must be the Artist’s own works, executed by your own hand and a product primarily of your imagination or design. Any artwork that uses or copies other’s ideas with taking appropriate permissions from the author of the original will be removed if it comes to our attention. This applies not only to the artwork but also for any comments or reviews or any other material passed off as original. Any violation of this policy will lead to immediate suspension of membership and legal action should the copyright owner pursue.

  2. Artists will desist from depicting any explicit or mature sexual content and any other themes which might be deemed as offensive such as excessive violence and gore. KALAA strictly prohibits any form of pornographic material on its site. Images containing nudity also may be banned from the site if it is deemed to be obscene. KALAA reserves its right to be the sole arbiter of what it deems as obscene.

  3. In the case of Photography using Models, we recommend that the Artist/Photographer obtain the necessary written permissions from the Model to publish, share, distribute, and sell the photographs. KALAA will not be liable for any claims or damages from the Models or subjects of the photographs. In any case the Artist/Photographer must not use any under-age models.

  4. Artists registered on KALAA are expected to maintain confidentiality of commercial information and not share this with anybody. Specifics of what constitutes information that is ‘Commercial confidential” will be specified in the “Terms and Conditions for Artists”


ADDITIONAL ETIQUETTE POLICIES FOR BUYERS


  1. Buyers are expected to provide current authentic and correct Shipping and Billing Address and contact information. They are expected to keep the information current and updated for any changes. Buyers will not misrepresent themselves by using a false identity.

  2. Buyers will obey all rules and regulations concerning purchase of art objects and items that are applicable in the country to which the artwork is shipped. KALAA will not be responsible for any violation of these laws by the Buyer, even if inadvertently.

  3. Buyers registered on KALAA are expected to maintain confidentiality of commercial information and not share this with anybody. Specifics of what constitutes information that is ‘Commercial confidential will be specified in the “Terms and Conditions for Buyers”
